I have been instructing Sunil Rupasinha to represent my clients for many years and continue to do so. Most recently I instructed him to represent one of my clients who had driven his car head on into an oncoming vehicle and then left the scene. He was subsequently arrested. The passengers in the other vehicle had to be cut free by the fire brigade. When my client was arrested and provided a breath specimen he was between 3-4 times over the breath alcohol limit. My client had always intended to plead ‘Guilty’ but I feared that he would be imprisoned based on the gravity of his conduct and the sentencing guidelines (which suggested an immediate custodial sentence should normally be imposed). Mr Rupasinha first saw my client in conference at my office where he soon gained his trust and confidence. The advice as to how best to present the plea in mitigation was clear and realistic. At court, Mr Rupasinha had to challenge a number of factual inaccuracies (the CPS had exaggerated the case against my client) before mitigating (which he did expertly in my view). My client was extremely relieved and grateful to Mr Rupasinha for helping him to avoid the imposition of an immediate custodial sentence.
